Terms of Use
Dominion Games Ltd. (“Dominion Games”, “we”, “us”, “our” and terms of similar meaning) provides you with the Wordmeetstee game (“Game”), as made available through third-party gaming and application providers (each a “Third-Party Provider”), subject to these terms of use (“Terms”).
Please read these Terms carefully before using the Game. By entering into these Terms and/or accessing or using the Game, you expressly acknowledge that you understand these Terms and accept all of its terms and conditions. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THESE TERMS, YOU MAY NOT ACCESS OR USE THE GAME.
Privacy Policy and Additional Policies
Please refer to Dominion Games’s privacy policy, available here (the “Privacy Policy”) for information on how Dominion Games collects, uses and discloses personally identifiable information and data from users of the Game. By accessing and/or using the Game, you agree to our collection, use and disclosure of personally identifiable information and data in accordance with the Privacy Policy.
In addition, by accessing and/or using the Game, you agree to be bound by any additional policies, guidelines, instructions, agreements and/or rules communicated through the Game (collectively, the “Additional Policies”). For example, we may post Additional Policies that specifically address your use of the Game. You agree to comply with such Additional Policies even if they are not identified in these Terms.
Access and Fees
In order to access and use the Game, you must have a valid, active account with a Third-Party Provider. When accessing the Game through a Third-Party Provider, you are responsible for: (i) maintaining the confidentiality of any user login information and/or password (as applicable) you may use to access your Third-Party Provider account and/or the Game and you agree not to transfer or lend or transfer the same to any third party; (ii) all access to and activity on such such account, including, without limitation, all interactions with the Game that occur in connection with such account; and (iii) your compliance with any agreement you may enter into with respect to such account. You agree to immediately notify us of any unauthorized use of or any other breach of security related to any Third-Party Provider account or the Game. We are not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations and you agree to indemnify and hold Dominion Games and the Released Parties, as defined herein, harmless for any improper or illegal use of the Game and/or your Third-Party Provider account(s). This includes illegal or improper use by someone to whom you have given permission to use or whom you have negligently allowed to access your Third-Party Provider account(s).
You further represent and warrant that all information you supply to us and/or any Third-Party Provider is complete and accurate. Knowingly submitting incomplete or inaccurate information to us and/or any Third-Party Provider may result in immediate termination of your participation, access to and/or use of the Game, which shall be determined in our sole discretion, to the extent legally permissible.
To use the Game, you are responsible for: (ii) the device you use to access the Game; (iii) the fees to connect to the applicable Third-Party Provider; and/or, as applicable, (iv) the fees for data or cellular usage to download and use the Game.
In consideration for the downloading and accessing the Game, you shall pay Dominion Games, in advance, the fees more particularly described on Dominion Games’s official website, found here, or Third-Party Provider(s) website. Except as otherwise specified herein such fees are based on the Game license purchased and not actual usage. You may be charged a fee by the Third-Party Provider(s) for downloading and accessing the Game. Dominion Games or the Third-Party Provider(s) may use other third-party payment service providers to process and collect applicable fees. Dominion Games reserves the right, in its sole discretion, to update its payment methods or change payment service providers by giving you reasonable advance notice. It is your responsibility to carefully read and agree to any terms of service or privacy policy of any payment service providers Dominion Games or its third-party (mobile) application providers may use from time-to-time. We have no responsibility or liability for any loss or damage you may sustain that is caused by any practices, actions, or breaches, relating to any payment service provider we may use.
Eligibility to use the Game and Parental Consent
If you want to use the Game, in addition to the other terms and conditions set out herein (i) you must be at least eighteen (18) years of age and able to form legally binding contracts under applicable law; or (ii) if you are under the age of eighteen (18), you must get permission from your Parent(s) (as defined below), who must also satisfy the preceding subsection (i). If you are under the age of thirteen (13), we may require verifiable consent from your Parent(s), which could involve us taking steps to ensure that your Parent(s) has/have actually consented to and agree(s) with you using the Game. If you are under the age of thirteen (13), you may be required to abide by the Third-Party Provider’s additional requirements to access the Game. The Parent(s), may, where authorized or permitted by law, and in accordance with these Terms, permit their child(ren) to use the Game, provided that the Parent(s), consent to and supervise such use. If a Parent(s) consents to their child(ren)’s use the Game, by providing such consent he/she/they is/are agreeing to be bound by these Terms in respect of their child(ren)’s use of the Game and he/she/they understand that Dominion Games will rely on these Terms in providing the Game to their child(ren). The Parent(s) shall guarantee the compliance, by their child(ren), of the terms and provisions of these Terms and represent(s) and warrant(s) that their child(ren) will not disaffirm these Terms at any time. The Parent(s) shall agree to indemnify and hold Dominion Games and its Released Parties (as defined herein) harmless from any and all damages, liabilities, costs or expenses of any kind or nature, including reasonable legal fees, which may arise from the breach by the Parent(s) and/or their child(ren) of any of the provisions of these Terms, including, without limitation, their child(ren)’s attempt to disaffirm or disavow these Terms on the ground of their status as a minor or otherwise.
“Parent(s)” means the individual legal parent or guardian or both legal parents or guardians, who have the sole physical care, custody and control of their child(ren) for which no judgment, order or decree has been made by any Court awarding the custody of their child(ren) to any other person or in any other manner affecting the status of the right of the Parent(s) as legal parent(s) and/or guardian(s) of their child(ren) and that the child(ren) has not been emancipated.
If only one Parent(s) (“Parent”) agrees to these Terms, then such Parent will be deemed to represent and warrant that said Parent has the exclusive authority to act on behalf of their child(ren) and on behalf of the other Parent(s), insofar as all matters related to the Game and these Terms are concerned and will indemnify and hold Dominion Games and its Released Parties harmless form any and all damages, liabilities, costs or expenses of any kind or nature including reasonable legal fees, which may be claimed by the other Parent(s), including, without limitation, any claim in any way related to their child(ren)’s attempt to disaffirm or disavow these Terms on the ground of their status as a minority or otherwise.
Ownership, Copyright and Trademarks
In these Terms, the content on the Game, including all information, data, logos, marks, designs, graphics, pictures, sound files, other files, and their selection and arrangement, is called “Content”.
The Game, all Content and all software available on the Game or used to create and operate the Game is the property of Dominion Games or its licensors and is protected by Canadian and international copyright laws, and all rights to the Game, such Content and such software are expressly reserved. All trademarks, registered trademarks, product names and company names or logos mentioned in the Game are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by Dominion Games.
License to use the Game
Dominion Games grants you a limited, revocable, non-exclusive, non-sublicensable license to access and use the Game and Content in accordance with these Terms (“License”). Other than as expressly permitted in these Terms, the Game and Content are subject to the following restrictions and terms:
The Game and Content are for your use only. You may not resell, lease or provide them in any other way to anyone else, except as permitted through these Terms and the Game.
You may not make or distribute copies of the Game or Content.
You may not alter, merge or translate the Game (including any of its source code or network transmissions) or the Content or decompile, copy, reverse engineer, disassemble the Game (including any of its source code or network transmissions), or otherwise reduce the Game (including any of its source code or network transmissions) to a human-perceivable form.
You may not modify or create derivative works based on the Game or Content.
You may not use the Game or Content for application or website deployment or ultimate production purposes.
You may not use the Game or Content to research, develop or create (or to facilitate any of the foregoing) any program, material, service, technology, product, application or website having the same or similar primary function as the Game or Content and/or that competes with the Game.
You may not remove or modify any copyright, trademark or other proprietary notices that have been placed in the Content.
You may not otherwise use the Game or Content other than for its intended purpose as specified therein and in these Terms.
Except as expressly permitted above, any use of any portion of the Content without the prior written permission of its owner is strictly prohibited and will terminate the License granted in this Section and these Terms. Any such unauthorized use may also violate applicable laws, including, without limitation, copyright and trademark laws.
Unless explicitly stated herein, nothing in these Terms may be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. The License granted in this Section, or any part thereof, is revocable by Dominion Games at any time.
Your use of the Game and Content must not infringe or violate the rights of any other party, breach any contract or legal duty to any other parties or violate any applicable law.
You may not perform any act, nor permit any act to be performed by a third party, that would harm, or in any way negatively affect or diminish Dominion Games’s intellectual property or other proprietary rights in or to the Game or Content or any other rights in law or equity of Dominion Games.
You may not provide information or act in a manner that is false, inaccurate, misleading (directly or by omission or failure to update information), defamatory, libelous, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, hateful or illegal.
You may not (i) index, scrape “data mine”, survey or in any way reproduce or circumvent the navigational structure or presentation of the Game; (ii) link directly or indirectly to any other websites, applications or services; (iii) attempt to use third-party websites, hacking programs, cheat codes, or related methods to hack or circumvent the Game’s or Dominion Games’s systems or policies; and/or (iv) attempt to send viruses, keyloggers, or trojans to Dominion Games’s contractors, employees or representatives or other users of the Game.
You may not transfer or sell the Content (as applicable).
Third-Party/Open-Source Software
The Game may contain and/or may connect to third-party software and/or open-source software, which may be subject to third-party licenses and require notices and/or additional terms and conditions (“Third-Party Licenses”). These Third-Party Licenses are made a part of and incorporated into these Terms. By accepting these Terms, you are also accepting the Third-Party Licenses, if any. Third-Party Service Providers
In the course of accessing or using the Game, you may be required or by your actions may be deemed, to create a user account and/or consent to the terms provided by certain third-party service providers, including but not limited to, Third-Party Providers, payment processors and social media login account providers (Facebook, Google, Apple etc.). You agree that nothing in those agreements shall, in any way, alter the Terms or your obligations hereunder. By accessing and using the Game, you acknowledge that you have read and undertake to abide by the Third-Party Providers’ policies and guidelines, as they may be amended from time to time, including but not limited to the Google Store rating policy.
Security of the Game
To ensure reliability, we use high grade hosting services and security technologies that we believe will provide you with a secure and safe environment when using the Game. For example, all Content and information on the Game is encrypted using SSL certificates, either directly by Dominion Games or from the Third-Party Providers. However, no system is perfectly secure or reliable. The Internet is an inherently insecure medium, and the reliability of hosting services, Internet intermediaries, your Internet service provider, and other service providers, including, without limitation, Third-Party Providers, cannot be assured. When you use the Game, you accept these risks and the responsibility for choosing to use a technology that cannot guarantee complete security and reliability. You may need to update third-party software from time to time in order to access and/or use the Game, such as upgrades to your personal device’s operating system. We are not responsible in any way for such third-party software or any updates thereto. You shall bear the sole responsibility and cost of performing any software upgrades/updates required to access the Game.

DOMINION GAMES EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Limitation of Liability and Indemnity
YOU WAIVE AND SHALL NOT ASSERT ANY CLAIMS OR ALLEGATIONS OF ANY NATURE WHATSOEVER AGAINST DOMINION GAMES, ITS AFFILIATES OR SUBSIDIARIES, THEIR SPONSORS, CONTRACTORS, ADVERTISERS, VENDORS OR OTHER PARTNERS, ANY OF THEIR SUCCESSORS OR ASSIGNS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, CONTRACTORS OR EMPLOYEES (COLLECTIVELY, THE “RELEASED PARTIES”) ARISING OUT OF OR IN ANY WAY RELATING TO YOUR USE OF THE GAME (INCLUDING YOUR INTERACTION WITH AND/OR ACCESS THERETO THROUGH A THIRD-PARTY PROVIDER) OR THE CONTENT, INCLUDING, WITHOUT LIMITATION, ANY CLAIMS OR ALLEGATIONS RELATING TO THE ALLEGED INFRINGEMENT OF PROPRIETARY RIGHTS, ALLEGED INACCURACY OF CONTENT, OR ALLEGATIONS THAT ANY RELEASED PARTY HAS OR SHOULD INDEMNIFY, DEFEND OR HOLD HARMLESS YOU OR ANY THIRD PARTY FROM ANY CLAIM OR ALLEGATION ARISING FROM YOUR USE OR OTHER EXPLOITATION OF THE GAME. YOU ASSUME THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE GAME, INCLUDING, WITHOUT LIMITATION, YOUR INTERACTION WITH AND/OR ACCESS THERETO THROUGH A THIRD-PARTY PROVIDER AND ANY DAMAGE TO YOUR COMPUTER HARDWARE, MOBILE DEVICE, DATA OR SOFTWARE.
NOTWITHSTANDING ANY PROVISION HEREIN AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF DOMINION GAMES, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER LEGAL THEORY, ARISING OUT OF OR RELATING TO THE ACCESS TO, USE OF OR ATTEMPTED ACCESS TO OR USE OF THE GAME EXCEED ANY COMPENSATION PAID BY YOU DIRECTLY TO DOMINION GAMES FOR ACCESS TO OR ONE HUNDRED DOLLARS (C$100).
YOU SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS DOMINION GAMES AND THE OTHER RELEASED PARTIES FROM ANY LOSS, DAMAGES, LIABILITIES, COSTS, EXPENSES, CLAIMS AND PROCEEDINGS IN ANY WAY CONNECTED WITH THESE TERMS OR YOUR ACCESS TO, USE OF OR ATTEMPTED ACCESS TO OR USE OF THE GAME AND YOUR INTERACTION WITH AND/OR ACCESS THERETO THROUGH A THIRD-PARTY PROVIDER, INCLUDING, WITHOUT LIMITATION (I) YOUR VIOLATION OF THE TERMS; (II) YOUR VIOLATION OF ANY THIRD-PARTY RIGHT OR THE RIGHTS OF ANOTHER USER OF THE GAME; (III) ANY BREACH OF A REPRESENTATION OR WARRANTY MADE BY YOU TO US, EITHER IN THE TERMS OR OTHERWISE; (IV) THE USE OF THE GAME BY ANY PERSON TO WHOM YOU GIVE ACCESS; (V) YOUR USE OF, ACCESS TO, AND/OR ACTIVITIES IN CONNECTION WITH THE GAME; (VI) ANY NEGLIGENT, RECKLESS, OR INTENTIONALLY WRONGFUL ACT; AND/OR (VII) ANY FAILURE TO USE THE GAME IN ACCORDANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS.
Communications
Notices that we give you (other than notice of amendment of these Terms, which is discussed below) may be provided through the applicable Third-Party Provider through which you access the Game.
Applicable Law and Venue
The Game is controlled by Dominion Games and may be operated by third party gaming distributors. You and Dominion Games both benefit from establishing a predictable legal environment regarding the Game. Therefore, you and Dominion Games explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Game will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Except where prohibited by applicable law, any claim, dispute or controversy (whether in contract or tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future) arising out of or relating to (a) these Terms; (b) the Game or Content; (c) oral or written statements, advertisements or promotions relating to these Terms or to the Game; or (d) the relationships that result from these Terms, the Game or Content (collectively, a “Claim”) will be referred to and determined by a sole arbitrator (to the exclusion of the courts). If you have a Claim, you should give written notice to arbitrate at the address specified below. If we have a Claim, we will give you notice to arbitrate at your address or contact information we have on file (if any). Arbitration will be conducted by one arbitrator pursuant to the commercial arbitration laws and rules in effect on the date of the notice in the Province of Ontario.
To the extent arbitration as described in the immediately preceding paragraph is prohibited by applicable law, you agree that all Claims will be heard and resolved in a court of competent jurisdiction located in Toronto, Ontario. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts.
To the extent permitted by law, you hereby waive your right to participate in any class action lawsuits against us and/or a Released Party. To the extent permitted by law, you further waive any right to a trial by jury, should such a right exist, in relation to any legal dispute connected to or in any way arising out of the Terms.
If you choose to access the Game from locations other than Ontario, you will be responsible for compliance with all local laws of such other jurisdiction and you agree to indemnify Dominion Games and the other Released Parties for your failure to comply with any such laws.
Modification of Terms
Dominion Games reserves the right to change or modify any of the terms and conditions contained in these Terms, at any time and in its sole discretion. If we do so, we will post a conspicuous notice through the applicable Third-Party Provider through which you access the Game. If you do not agree with the changes, please do not use the Game. Unless otherwise specified, any changes or modifications will be effective immediately upon posting of the revisions through the applicable Third-Party Provider through which you access the Game, and your continued use of the Game after such time will constitute your acceptance of such changes or modifications. You should from time to time review the Terms to understand the terms and conditions that apply to your use of the Game. The Terms will always show the ‘Last Updated’ date at the top. Termination of License, use of the Game and the Terms
Notwithstanding any provision of these Terms, Dominion Games reserves the right, in its sole discretion, without any notice or liability to you, to (a) terminate your license to use the Game, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of the Game or Content; (c) change, suspend or discontinue any aspect of the Game or Content; and (d) impose limits on the Game or Content.
For greater certainty, Dominion Games may terminate these Terms and your use of the Game at any time. If these Terms expire or terminate for any reason, Sections 3, 4, 9, 10, 12, 14 and 15, and any representation or warranty you make in these Terms, shall also survive indefinitely.
Miscellaneous
You acknowledge that you have read the Terms and are familiar with all of the terms, covenants and conditions contained herein, and that you will not revoke said consent during the term of these Terms. If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. Dominion Games may assign any or all of its rights hereunder to any party without your consent. You are not permitted to assign any of your rights or obligations hereunder without the prior written consent of Dominion Games, and any such attempted assignment will be void and unenforceable. Singular terms shall be construed as plural, and vice versa, where the context requires. Section headings are a matter of convenience and shall not be considered part of these Terms. These Terms constitute the entire agreement between you and Dominion Games regarding your use of the Game, and supercede all prior or contemporaneous communications whether electronic, oral or written between you and Dominion Games regarding your use of the Game. The parties confirm that it is their wish that these Terms, as well as any other documents relating to these Terms, including notices, have been and shall be drawn up in the English language only.
